The LEV Record-Keeping Problem Costing UK Businesses

HSE ran 4,000 targeted dust inspections in 2024/25. Poor LEV record-keeping is one of the top reasons businesses fail. Here is what puts you at risk.

Missed TExT Deadlines

The 14-month testing cycle is easy to lose track of with paper diaries. One missed deadline means instant non-compliance if HSE visits.

Lost or Incomplete Paper Records

Paper logbooks get damaged, misplaced, or filled in inconsistently. When an inspector asks for 5 years of records, gaps mean trouble.

Six-Figure Fines and Prosecution

COSHH breaches carry serious penalties. Enforcement notices, prosecution, and fines reaching six figures are real consequences for businesses that cannot prove compliance.

No Dedicated H&S Staff

Most SMEs rely on owners or part-time coordinators for compliance. Without a system, LEV record-keeping falls through the cracks alongside daily operations.

Frequently Asked Questions

About LEV Compliance

How often should LEV systems be tested?
Under COSHH Regulation 9, LEV systems must receive a thorough examination and test (TExT) at least every 14 months. Some industries require more frequent testing. Between formal tests, employers should carry out regular user checks to ensure the system is working correctly.
What records do I need to keep for LEV testing?
You must retain LEV examination and test records for at least 5 years under COSHH Regulation 9. Records should include the date of each TExT, the name of the competent person who carried it out, the condition of the equipment, and any repairs or modifications made. HSE inspectors can request these records at any time.
What happens if I fail an HSE LEV inspection?
HSE can issue improvement notices, prohibition notices, or prosecute for non-compliance. Fines for COSHH breaches can reach six figures, and in serious cases directors can face personal liability. Poor record-keeping is one of the most common reasons businesses fail LEV inspections.
Can I do my own LEV testing?
There is an important distinction between daily user checks and formal thorough examination and testing (TExT). Employers and employees can carry out routine user checks such as visual inspections and airflow monitoring. However, the 14-month TExT must be performed by a competent person with specialist knowledge of your LEV system.
What is HSG258?
HSG258 is HSE’s official guidance document on controlling airborne contaminants at work. It covers the design, maintenance, examination, and testing of local exhaust ventilation systems. The guidance explains employer duties under COSHH and provides practical advice on keeping LEV systems effective.
What does LEV stand for?
LEV stands for Local Exhaust Ventilation. It refers to engineering systems designed to capture airborne contaminants such as dust, fumes, vapour, and mist at source before they spread into the workplace. Common examples include dust extraction units, fume cupboards, spray booth ventilation, and welding fume extractors.
